Master User Agreement: Acceptance of Terms

This Master User Agreement constitutes a binding contract between you, the User, and Thrillophilia Adventure Tours Pvt. Ltd. with regard to the use of various services that are provided by Thrillophilia Adventure Tours Pvt. Ltd.

1.1 Thrillophilia Adventure Tours Pvt. Ltd. ("Thrillophilia"), a company incorporated under the laws of India, with its operational office at 4th Floor, 2628, 27th main, 1st sector,HSR layout,Bangalore, Karnataka   560102 India, provides various travel related services through its Website (www.thrillophilia.com), retail outlets, mobile-cellular technology as well as through its call-center.

1.2 Thrillophilia shall provide you ("User") travel-related information, pricing, availability and reservations for airlines, hotels, railway, holiday packages, bus and car rentals across cities and rural areas throughout India ("Service"). This Service may be availed by the User in India at any time during the year as is offered by various third party vendors like airlines, hotels, etc. ("Service Providers").

1.3 This Master User Agreement ("Agreement") is applicable to all Thrillophilia Services. In addition to this Agreement and depending on the Services opted for by the User, the User shall be required to read and accept the relevant terms and conditions of service ("TOS") for each such Service, which may be updated or modified by Thrillophilia from time to time. Such TOS shall be deemed to be a part of this Agreement and in the event of a conflict between such TOS and this Agreement, the terms of this Agreement shall prevail.

1.4 Thrillophilia Services are offered to the User conditioned on acceptance without modification of all the terms, conditions and notices contained in this Agreement and the TOS, as may be posted on the Website from time to time. For the removal of doubts, it is clarified that availing of the Services by the User constitutes an acknowledgement and acceptance by the User of this Agreement and the TOS. If the User does not agree with any part of such terms, conditions and notices, the User must not avail Thrillophilia Services.

1.5 Additionally, the Service Provider itself may provide terms and guidelines that govern particular features, offers or the operating rules and policies applicable to each Service (for example, flights, hotel reservations, packages, etc.). The User shall be responsible for ensuring compliance with the terms and guidelines or operating rules and policies of the Service Provider with whom the User elects to deal, including terms and conditions set forth in a Service Providers' fare rules, contract of carriage or house rules.

1.6 Thrillophilia at its sole discretion reserves the right not to accept any order placed by the user through the website, phone or email  without assigning any reason thereof. Any contract to provide any service by Thrillophilia is not complete until full money towards the service is received from the user and accepted by Thrillophilia.

2. Modification of Terms
Thrillophilia reserves the right to change the terms, conditions and notices under which the Services are offered through the Website, including but not limited to the charges for the Services provided through the Website. The User shall be responsible for regularly reviewing these terms and conditions.

3. Privacy Policy
The User hereby consents, expresses and agrees that he has read and fully understands the Privacy Policy of Thrillophilia. The User further consents that the terms and contents of such Privacy Policy are acceptable to him.

4. Limited User
4.1 The User agrees and undertakes not to sell, trade or resell or exploit for any commercial purposes, any portion of the Service. For the removal of doubt, it is clarified that Thrillophilia Services, including the use of the Website, is not for commercial use but is specifically meant for personal use only.

4.2 The User further agrees and undertakes not to reverse engineer, modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information, software, products or services obtained from the Website. Limited reproduction and copying of the content of the Website is permitted provided that the Thrillophilia's name is stated as the source. For the removal of doubt, it is clarified that unlimited or wholesale reproduction, copying of the content for commercial or non-commercial purposes and unwarranted modification of data and information within the content of the Website is not permitted.

5. Disclaimer of Warranties/Limitation of Liability  
5.1 Thrillophilia has endeavored to ensure that all the information provided by it is correct, but Thrillophilia neither warrants nor makes any representations regarding the quality, accuracy or completeness of any data or information. Thrillophilia makes no warranty, express or implied, concerning the website and/or its contents and disclaims all warranties of fitness for a particular purpose and warranties of merchantability in respect of services, including any liability, responsibility or any other claim, whatsoever, in respect of any loss, whether direct or consequential, to any user or any other person, arising out of or from the use of any such information.

5.2 To the extent Thrillophilia acts only as a booking agent on behalf of third party service providers, it shall not have any liability whatsoever for any aspect of the arrangements between the service provider and the user as regards the standards of services provided by the service providers. In no circumstances shall Thrillophilia be liable for the services provided by the service provider.

5.3 Although Thrillophilia makes reasonable commercial efforts to ensure that the description and content in the TOS and on each page of the website is correct, it does not, however, take responsibility for changes that occurred due to human or data entry errors or for any loss or damages suffered by any user due to any information contained herein.

Also, Thrillophilia is not the service provider (except Bangalore ) and cannot therefore control or prevent changes in the published descriptions or oral representations, which are always based upon information provided by the service providers.

5.4 Thrillophilia does not endorse any advertiser on its website in any manner. The users are requested to verify the accuracy of all information on their own before undertaking any reliance on such information.

5.5 Thrillophilia does not, by offering travel related services to particular destinations, represent or warrant that travel to such destinations is without risk, and shall not be liable for damages or losses that may result from travel to such destinations.

5.6 In no event shall Thrillophilia be liable for any direct, indirect, punitive, incidental, special, consequential damages or any other damages resulting from: (a) the use or the inability to use the services; (b) the cost of procurement of substitute goods and services or resulting from any goods, information or services purchased or obtained or messages received or transactions entered into through the services; (c) unauthorized access to or alteration of the user's transmissions or data; (d) any other matter relating to the services; including, without limitation, damages for loss of use, data or profits, arising out of or in any way connected with availing services from Thrillophilia.

Neither shall Thrillophilia be responsible for the delay or inability to use the website or services, the provision of or failure to provide services, or for any information, software, products, services and related graphics obtained from Thrillophilia, whether based on contract, tort, negligence, strict liability or otherwise. Further, Thrillophilia shall not be held responsible for non-availability of the website during periodic maintenance operations or any unplanned suspension of access to the services that may occur due to technical reasons or for any reason beyond Thrillophilia's control. The user understands and agrees that any material and/or data downloaded or otherwise obtained from Thrillophilia is done entirely at their own discretion and risk and they will be solely responsible for any damage to their computer systems or any other loss that results from such material and/or data.

These limitations, disclaimer of warranties and exclusions apply without regard to whether the damages arise from (a) breach of contract, (b) breach of warranty, (c) negligence, or (d) any other cause of action, to the extent such exclusion and limitations are not prohibited by applicable law.

The maximum liability on part of Thrillophilia arising under any circumstances, in respect of any services availed, shall be limited up to a maximum of the refund of total amount received from the customer for availing the services less any cancellation, refund or others charges, as may be applicable. In no case the liability shall include any consequential loss, damage or additional expense whatsoever.

6. Links to Third Party Sites  
6.1 The Website may contain links to other websites ("Linked Sites"). The Linked Sites are not under the control of Thrillophilia or the Website and Thrillophilia is not responsible for the contents of any Linked Site, including without limitation any link contained in a Linked Site, or any changes or updates to a Linked Site. Thrillophilia is not responsible for any form of transmission, whatsoever, received by the User from any Linked Site. Thrillophilia is providing these links to the User only as a convenience, and the inclusion of any link does not imply endorsement by Thrillophilia or the Website of the Linked Sites or any association with its operators or owners including the legal heirs or assigns thereof.

6.2 Thrillophilia is not responsible for any errors, omissions or representations on any Linked Site. Thrillophilia does not endorse any advertiser on any Linked Site in any manner. The Users are requested to verify the accuracy of all information on their own before undertaking any reliance on such information.

7. Prohibition Against Unlawful Use  
As a condition of the use of the Website, the User warrants that they will not use the Website for any purpose that is unlawful or illegal under any law for the time being in force within or outside India or prohibited by this Agreement and/or the TOS including both specific and implied. In addition, the Website shall not be used in any manner, which could damage, disable, overburden or impair it or interfere with any other party's use and/or enjoyment of the Website. The User shall refrain from obtaining or attempting to obtain any materials or information through any means not intentionally made available or provided for or through the Website.

8. Use of Communication Services  
8.1 The Website may contain services such as email, chat, bulletin board services, information related to various tourist spots, news groups, forums, communities, personal web pages, calendars, and/or other message (hereinafter collectively referred to as "Communication Services"). The User agrees and undertakes to use the Communication Services only to post, send and receive messages and material that are proper and related to the particular Communication Service. By way of example, and not as a limitation, the User agrees and undertakes that when using a Communication Service, the User will not:
(a) defame, abuse, harass, stalk, threaten or otherwise violate the legal rights of others;
(b) publish, post, upload, distribute or disseminate any inappropriate, profane, defamatory, infringing, obscene, indecent or unlawful topic, name, material or information;
(c) upload files that contain software or other material protected by intellectual property laws unless the User owns or controls the rights thereto or have received all necessary consents;
(d) upload or distribute files that contain viruses, corrupted files, or any other similar software or programs that may damage the operation of the Website or another's computer;
(e) advertise or offer to sell or buy any goods or services for any business purpose, unless such Communication Service specifically allows such messages;
(f) conduct or forward surveys, contests, pyramid schemes or chain letters;
(g) download any file posted by another user of a Communication Service that the User know, or reasonably should know, cannot be legally distributed in such manner;
(h) falsify or delete any author attributions, legal or other proper notices or proprietary designations or labels of the origin or source of software or other material contained in a file that is uploaded;
(i) violate any code of conduct or other guidelines, which may be applicable for or to any particular Communication Service;
(j) violate any applicable laws or regulations for the time being in force in or outside India; and
(k) violate any of the terms and conditions of this Agreement or any other terms and conditions for the use of the Website contained elsewhere herein.

8.2 Thrillophilia will review materials posted through Communication Service and shall remove any materials in its sole discretion. Thrillophilia reserves the right to terminate the User's access to any or all of the Communication Services at any time without notice for any reason whatsoever.

8.3 Thrillophilia reserves the right at all times to disclose any information as is necessary to satisfy or comply with any applicable law, regulation, legal process or governmental request, or to edit, refuse to post or to remove any information or materials, in whole or in part, in Thrillophilia's sole discretion.

8.4 Thrillophilia does not control or endorse the content, messages or information found in any communication service and, therefore, Thrillophilia specifically disclaims any liability or responsibility whatsoever with regard to the communication services and any actions resulting from the user's participation in any communication service.

8.5 Materials uploaded to a Communication Service may be subject to posted limitations on usage, reproduction and/or dissemination. User is responsible for keeping himself updated of and adhering to such limitations if they download the materials.

8.6 When you register with Thrillophilia.com, we or any of our partners/affiliate/group companies may contact you from time to time to provide the offers/information of such products/services that we believe may benefit you.

9. Termination/Access Restriction  
Thrillophilia reserves the right, in its sole discretion, to terminate the access to the website and the related services or any portion thereof at any time, without notice.

10. Fees Payment
10.1 Thrillophilia reserves the right to charge listing fees for certain listings, as well as transaction fees based on certain completed transactions using the Thrillophilia Services. Thrillophilia further reserves the right to alter any and all fees from time to time, without notice.

10.2 The User shall be liable to pay all applicable charges, fees, duties, taxes, levies and assessments for availing the Thrillophilia Services.

11. User's Obligations and User Account  
11.1 The User represent and confirm that the User is of legal age to enter into a binding contract and is not a person barred from availing the Services under the laws of India or other applicable law.

11.2 To avail a Service through the Website/Phone or email, the User has and must continue to maintain at his sole cost: (a) all the necessary equipments including a computer and modem etc. to access the Website/avail Services; (b) own access to the World Wide Web. The User shall be responsible for accessing the Services and that access may involve third party fees including, airtime charges or internet service provider's charges which are to be exclusively borne by the User.

11.3 The user also understands that the services may include certain communications from Thrillophilia as service announcements and administrative messages. The user understands and agrees that the services are provided on an "as is" basis and that Thrillophilia does not assume any responsibility for deletions, mis-delivery or failure to store any user communications or personalized settings.

11.4 Registration of the User on the Website is optional. If the User opts to register himself on the Website, upon completion of the registration process, the User shall receive a user id and password. The User agrees and undertakes at all times to be responsible for maintaining the confidentiality of the password and user id, and shall be fully responsible for all activities that occur by use of such password or user id. Further, the User agrees not to use any other party's under id and password for any purpose whatsoever without proper authorization from such party. You are responsible for the security of your password and for all transactions undertaken using your password through our service. The Password entered by you is transmitted in one- way encrypted form to our database and stored as such. Thus the Password will not be known even to Thrillophilia. You confirm that you are the authorised holder of the credit card or the original account holder used in the transactions you make using the Thrillophilia services. Thrillophilia will not be responsible for any financial loss, inconvenience or mental agony resulting from misuse of your ID/password/credit card number/account details number for using Thrillophilia Services.

11.5 The user also agrees and undertakes to immediately notify Thrillophilia of any unauthorized use of the user's password or user id and to ensure that the user logs off at the end of each session at the website. Thrillophilia shall not be responsible for any, direct or indirect, loss or damage arising out of the user's failure to comply with this requirement.

11.6 The User also agrees to: (a) provide true, accurate and complete information about himself and his beneficiaries as prompted by the registration form ("Registration Data") on the Website; and (b) maintain and promptly update the Registration Data to keep it true, accurate, current and complete. If the User provide any information that is untrue, inaccurate, not current or incomplete or Thrillophilia has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, Thrillophilia has the right to suspend or terminate the User's registration and refuse any and all current or future use of the Website and/or any Service.

11.7 Furthermore, the User grants Thrillophilia the right to disclose to third parties Registration Data to the extent necessary for the purpose of carrying out the Services.

12. Breach
12.1 Without prejudice to the other remedies available to Thrillophilia under this agreement, the TOS or under applicable law, Thrillophilia may limit the user's activity, or end the user's listing, warn other users of the user's actions, immediately temporarily/indefinitely suspend or terminate the user's registration, and/or refuse to provide the user with access to the website if:
(a) the user is in breach of this agreement, the TOS and/or the documents it incorporates by reference;
(b) Thrillophilia is unable to verify or authenticate any information provided by the user; or
(c) Thrillophilia believes that the user's actions may infringe on any third party rights or breach any applicable law or otherwise result in any liability for the user, other users of the website and/or Thrillophilia.

12.2 Thrillophilia may at any time in its sole discretion reinstate suspended users. Once the user have been indefinitely suspended the user may not register or attempt to register with Thrillophilia or use the website in any manner whatsoever until such time that the user is reinstated by Thrillophilia. Notwithstanding the foregoing, if the user breaches this agreement, the TOS or the documents it incorporates by reference, Thrillophilia reserves the right to recover any amounts due and owing by the user to Thrillophilia and/or the service provider and to take strict legal action as Thrillophilia deems necessary.

13. Proprietary Rights
13.1 Thrillophilia may provide the User with content such as sound, photographs, graphics, video or other material contained in sponsor advertisements or information. This material may be protected by copyrights, trademarks or other intellectual property rights and laws. The User may use this material only as expressly authorized by Thrillophilia and shall not copy, transmit or create derivative works of such material without express authorization from Thrillophilia.

13.2 The User acknowledges and agrees that they shall not upload, post, reproduce or distribute any content on or through the Website that is protected by copyright or other proprietary right of a third party, without obtaining the permission of the owner of such right. Any copyrighted or other proprietary content distributed on or through the Website with the consent of the owner must contain the appropriate copyright or other proprietary rights notice. The unauthorized submission or distribution of copyrighted or other proprietary content is illegal and could subject the User to personal liability or criminal prosecution.

14. Relationship
None of the provisions of this Agreement, terms and conditions, notices or the right to use the Website by the User contained herein or any other section or pages of the Website and/or the Linked Sites, shall be deemed to constitute a partnership between the User and Thrillophilia and no party shall have any authority to bind or shall be deemed to be the agent of the other in any way. It may be noted, however, that if by using the Website, the User authorizes Thrillophilia and its agents to access third party sites designated by them or on their behalf for retrieving requested information, the User shall be deemed to have appointed Thrillophilia and its agents as their agent for this purpose.

15. Headings
The headings and subheadings herein are included for convenience and identification only and are not intended to describe, interpret, define or limit the scope, extent or intent of this Agreement, the TOS or the right to use the Website by the User contained herein or any other section or pages of the Website or any Linked Sites in any manner whatsoever.

16. Interpretation of Number and Genders
The terms and conditions herein shall apply equally to both the singular and plural form of the terms defined. Whenever the context may require, any pronoun shall include the corresponding masculine and feminine. The words "include", "includes" and "including" shall be deemed to be followed by the phrase "without limitation". Unless the context otherwise requires, the terms "herein", "hereof", "hereto", "hereunder" and words of similar import refer to this Agreement as a whole.

17. Indemnification
The User agrees to indemnify, defend and hold harmless Thrillophilia from and against any and all losses, liabilities, claims, damages, costs and expenses (including legal fees and disbursements in connection therewith and interest chargeable thereon) asserted against or incurred by Thrillophilia that arise out of, result from, or may be payable by virtue of, any breach or non-performance of any representation, warranty, covenant or agreement made or obligation to be performed by the User pursuant to this Agreement and/or the TOS.

18. Severability
If any provision of this Agreement is determined to be invalid or unenforceable in whole or in part, such invalidity or unenforceability shall attach only to such provision or part of such provision and the remaining part of such provision and all other provisions of this Agreement shall continue to be in full force and effect.

19. Termination of Agreement and Services
19.1 Either the User or Thrillophilia may terminate this Agreement and a Service with or without cause at any time to be effective immediately.

19.2 The User agrees that Thrillophilia may under certain circumstances and without prior notice, immediately terminate the User's user id and access to the Website/Services. Causes for termination may include, but shall not be limited to, breach by the User of this Agreement or the TOS, requests by enforcement or government agencies, requests by the User, non-payment of fees owed by the User in connection with the Services as specified in the applicable TOS.

19.3 This Agreement may be terminated by either the User or Thrillophilia through a written notice to the other. Thrillophilia shall not be liable to the User or any third party for termination of any Service. Should the User object to any terms and conditions of this Agreement, any TOS or become dissatisfied with the Service in any way, the User's only recourse is to immediately: (a) discontinue use of the Website/Service; and (b) notify Thrillophilia of such discontinuance.

19.4 Upon termination of the Service, User's right to use the Website/Services and software shall immediately cease. The User shall have no right and Thrillophilia shall have no obligation thereafter to execute any of the User's uncompleted tasks or forward any unread or unsent messages to the User or any third party. Once the User's registration or the Services are terminated, cancelled or suspended, any data that the User has stored on the Website may not be retrieved later.

20. Notices  
All notices and communications (including those related to changes in the TOS, Service, termination of Service etc.,) shall be in writing, in English and shall deemed given if delivered personally or by commercial messenger or courier service, or mailed by registered or certified mail (return receipt requested) or sent via email/facsimile (with acknowledgment of complete transmission) to the following address:
(a) If to Thrillophilia, at notice@Thrillophilia.com and/or at the address posted on the Website.
(b) If to a non registered User, at the communication and/or email address specified in the application form availing of a Thrillophilia Service.
(c) If to a registered User, at the communication and/or email address specified in the registration form.
Notice shall be deemed to have been served 48 hours after it has been sent, dispatched, displayed, as the case may be, unless, where notice has been sent by email, it comes to the knowledge of the sending party, that the email address is invalid.

21. Governing Law  
This agreement and each TOS shall be governed by and constructed in accordance with the laws of India without reference to conflict of laws principles and disputes arising in relation hereto shall be subject to the exclusive jurisdiction of the courts of Bangalore, Karnataka.

Important Notes -

• The travel industry in much of Asia is still in its infancy. While the freshness and novelty of tourism in these countries is part of the appeal to many visitors, others might see things differently. It is important to recognize that the level of service and standards in some areas, while improving, is not yet comparable to service standards in more mature travel destinations.
• The information contained in these Terms and Conditions is part of your contract with us. Once we have accepted your reservation and you have paid your Deposit there will be a legally binding contract between us.
• The Terms and Conditions can only be varied or modified in writing by us and no employee or agent, including your travel agent, has the authority to modify or vary these Terms and Conditions.
• It is your responsibility to read these Terms and Conditions carefully and if you do not understand them you must contact your travel agent 
for further information.

Deposit  - Subject to the Important Notes above, a minimum non-refundable deposit of 10,000 INR per person, per journey is due and payable when reservations are initiated.

Receipt of the non-refundable deposit from you is deemed evidence that you have read and accepted these Terms & Conditions.

Final Payment  - You must pay the balance for the journey and provide full details of your travel insurance at least 15 days prior to departure. For reservations made less than 15 days prior to departure, you must provide full payment and complete booking details (including full insurance details) at the time of making the reservation. Your reservation cannot be accepted or confirmed until we have received full payment and complete booking details from you. Failure to pay in full by this due date or to provide full travel insurance details will result in the reservations being automatically cancelled and you being held responsible for any cancellation fees as per our cancellation policy.

Late Bookings  - A late booking fee of per new booking will apply for bookings made within 21 days prior to travel departure date, with the late booking fee to be paid at the time of booking.

Validity & Pricing  - Prices are quoted in INR  and are valid for travel for the date ranges shown for each journey. We will use our reasonable efforts to ensure the prices do not change but we may be required to impose surcharges depending on currency fluctuations, changes in government legislation, air prices, fuel surcharges or other variables outside our control. You acknowledge and agree that you shall be responsible for the prompt payment of all surcharges and price increases. In order to minimize exposure to surcharges we recommend you pay in full as early as possible. Please be sure to confirm details of journey arrangements at the time of booking. INDIA/Foreign Taxes, INFORMATION AND PRICES ARE CURRENT AT THE TIME OF PUBLICATION. AIRLINES FREQUENTLY CHANGE THEIR PRICES AS A RESULT OF FARE INCREASES AND/OR FUEL SURCHARGES. PRICES MAY DIFFER WHEN YOU BOOK YOUR TRAVEL AND ARE NOT GUARANTEED UNTIL FULL PAYMENT IS RECEIVED FOR THE FINAL INVOICE PRICE. PLEASE CONTACT US FOR OUR CURRENT PRICES.

Future Journey Information  - Prices, dates and itineraries for travel after December are particularly subject to change, because our journeys will be subject to content review late in the calendar year.

Journey Cancellations  - Requests for cancellation of confirmed bookings must be made in writing and addressed to your travel consultant and will be subject to the following cancellation fees applied per person, per journey:

• More than 65 days prior to departure - Deposit 
• 65 - 50 days prior to departure - 25% of journey price or Deposit, whichever is greater 
• 49 - 35 days prior to departure - 50% of journey price or 15,000 INR, whichever is greater 
• Within 35 days prior to departure - 100% of journey price

We strongly recommend taking out travel insurance at time of deposit to cover insurable risks.

Refunds and Unused Services  - Travel arrangements cancelled, amended or altered within 24 hours of your departure or once travel has commenced do not qualify for any refund whatsoever. Services unused or cancelled for any reason are not refundable.

Journey Amendments  - No amendments to your journey will be processed until the deposit has been received. Up to 65 days prior to departure, one permitted amendment per booking is permitted free of charge. Thrillophilia has the right to charge for subsequent permitted amendments, as follows:

• More than 65 days prior to departure - 1000 INR per booking 
• 65 - 50 days prior to departure - 2000 INR per person, per journey 
• Within 50 days prior to departure - standard Cancellation Fees will apply, and full price will apply to new arrangements

These amendment charges are in addition to any charges passed on to us by any suppliers such as airlines, hotels or other tour operators.

Permitted amendments include, without limitation, changes to accommodation or travel arrangements. Name changes are not permitted as many suppliers deem a name change to constitute a cancellation and re-booking.

An amended booking which is subsequently cancelled will be subject to the cancellation fee of either the original departure date at time of amendment or the subsequent date, (whichever is the greater).

Airfares, Cancellations & Amendments  - Prices do not include airfares from or to your departing destination. Check with your agent for fares with all carriers to Asia. If you cancel your reservation, it is your responsibility to pay any cancellations fees imposed by the airline of up to 100% of the airfare. Any deviation from the set itinerary may also affect the airfare, and you will be responsible for payment of any increase in the airfare should you change the set itinerary. After the air ticket is written, any change requiring ticket re-issuance such as change in airline dates, routing, stops, or change of name due to the name provided to your agent not being exactly the same as the name on the passport will be assessed a 1000 INR change fee plus any change and cancellation penalties charged by the airlines. You are responsible for paying such additional Taxes and Fees.

Insurance  - Medical facilities across Asia are often unable to provide the full range of medical services that are available in developed countries, making evacuation a requirement in many non-life threatening medical situations. The costs of evacuation as well as international standard care are extremely high. In the most serious emergencies, travelers may not be capable of authorizing payment for an appropriate medical response that is urgently required. This may delay or prevent the provision of critical and possibly life-saving medical attention.

It is a condition of travel on Group Journeys that all travelers are adequately covered by travel insurance prior to arrival. Insurance should cover personal accident and medical expenses, evacuation and repatriation, baggage loss, and cancellation or curtailment of vacation. Your insurance details must be supplied to us at the time of booking. If you fail to provide the requested insurance information, we reserve the right, acting in our sole discretion, to cancel bookings and apply charges as per our cancellation policy. Travelers will be asked to provide their insurance details upon arrival in Asia as part of the registration process, and in the event that possession of an appropriate insurance policy is unable to be confirmed, in the interests of the traveler and fellow travelers, Thrillophilia reserves the right, acting in its sole discretion, to prohibit participation in the journey. In such instances, we will use our reasonable efforts to assist with onward travel arrangements for the relevant traveler, however full Cancellation Fees will apply.

Note that travel insurance 'attached' to credit cards is often limited in scope (e.g. not covering serious medical, repatriation or evacuation expenses) and in any case is usually effective only if travel arrangements have been purchased with the card. Please note also that government regulations in Asia do not always require or enforce the possession of liability insurance by hotels, transport and other suppliers. Even when insurance is in place, it can be for very limited coverage only. Thrillophilia does its best to work with suppliers who possess liability insurance, however it is not always possible to find and contract with such suppliers.

Responsibility  - Thrillophilia purchases transportation, hotel accommodations, restaurant services, and other services from various independent suppliers that are not subject to its control. THRILLOPHILIA CANNOT, THEREFORE, BE LIABLE FOR ANY PERSONAL INJURY OR PROPERTY DAMAGE, OR ANY OTHER SPECIAL, CONSEQUENTIAL or incidental DAMAGES that may occur due to

(a) intentional, wrongful, negligent, or arbitrary acts or omissions on the part of a supplier, its employees and others not under the direct control of Thrillophilia , or 
(b) defects or failures of any aircraft, vessel, automotive vehicle or other equipment or instrumentality under the control of independent suppliers.

In addition, Thrillophilia cannot be liable for delays in departure or interruption of your vacation arrangements caused by weather conditions, technical problems of any aircraft, vessel, automotive vehicle or other equipment or instrumentality, strikes, war, terrorist activity, civil commotion or any causes beyond the control of Thrillophilia. In no event will Thrillophilia be responsible for incidental, consequential or special or incidental damage or loss suffered by any person. Thrillophilia's maximum liability, for any reason whatsoever, will be limited to the amount paid to Thrillophilia for its services. In issuing tickets and coupons for transportation of the purchaser by any means, and making arrangements for hotel or other accommodation, Thrillophilia is not acting as principal but only as agent for the companies, corporation or person providing or offering the means of transportation and accommodation. To the extent Thrillophilia shall not be acting as an agent, as stated above, is shall be deemed to be acting as an agent of the purchasers in arranging or booking transportation and accommodation. Airlines and other transportation providers (e.g., boat operators) are not liable for any detention, delays, loss, damage, sickness or injury, however or by whoever caused, during the time passengers are not on board their planes or conveyances. The contract of carriage used by such transportation providers when issued shall constitute the sole contract between the transportation providers and the purchaser of these vacation arrangements.

What is Not Included  - Items of a personal nature such as laundry, drinks, telephone and fax charges, visa and passport fees, vaccinations, meals not specified, gratuities (unless specified), and departure taxes.

Alterations to Travel Arrangements  - a) Every effort will be made to provide these vacations exactly as described, booked and invoiced. Thrillophilia reserves the right to alter or cancel travel arrangements at any time. Thrillophilia will then provide, wherever possible, similar travel arrangements. If the arrangements provided are of higher standard, there will be an extra charge to you. b) In the case of a supplier failing to supply travel arrangements as reserved, either shortly before or on arrival, Thrillophilia will make every effort to provide alternative arrangements on the above basis, but shall not otherwise be liable to compensate you where such failure on the part of the supplier to provide travel arrangements is beyond our control.

Accommodation  - Twin share accommodation is based on two single beds or one double bed as provided by the hotel. Hotels provide triple share accommodation generally with a twin or double bedded room and one rollaway bed. A single supplement must be booked by people wishing to travel alone. Special requests such as non-smoking floors or king-size beds cannot be guaranteed.

Quick pointers::

·         We reserve the right to correct any errors in rates quoted or calculated for any service, with immediate effect. We will use our reasonable efforts to notify you of such corrections.

·         None of our day trips shall start after 11 PM and before 6 AM in the morning. If in any case a journey is required in the aforesaid time, a special written permission will be required from Thrillophilia management.

·         Thrillophilia sources transportation from its vendors and for any delay in vehicle due to natural calamities, vehicle damage, traffic etc Thrillophilia would not be responsible.

·         A standard vehicle is given in all our trips unless specified by the client. Extra cost related to an advanced vehicle will be passed on to the customer.

·         Thrillophilia will not be responsible for any adventure activity that couldn't take place because of the bad weather and in such a case no refund will be issued to the client.

·         It is mandatory for clients to fill the risk form before the commencement of any adventure activity, failing to which he/she will not be allowed to participate in any activity.

Group Journeys Led Tour Leaders  - A tour leader will accompany groups if 10 or more travelers are booked on a journey 30 days prior to its departure. Tour leader scheduling occurs 30 days prior to commencement of the relevant tour. If a journey increases to 10 travelers within 30 days of commencement we will use our reasonable efforts to secure a tour leader but this cannot be guaranteed. Most of our tour leaders live in India and have in-depth knowledge of India and a passion for local cultures, customs, and history. Tour leaders work in partnership with local guides to provide an optimum service for clients. The maximum group size is 18 passengers on India tours.

Group Journeys Led by Local Guide Only  - If you book a Group Journey which has less than 10 travelers, 40 days prior to departure you will be advised that the journey will likely operate with local English or Hindi-speaking guides only (i.e. a Tour leader will not accompany the local English-speaking guides). In some situations there will be a single local guide for the entire trip duration, however, in most cases there is a separate local guide in each city. Thrillophilia takes great pride in the quality of local guides it recruits and trains and has operated many very successful locally-led Journeys, where groups are usually 4 to 6 people in size. However, 35 days prior to departure we do ask that you confirm you are happy to travel with local guides. If you do not want to participate in the journey with local guides only, you must immediately notify us in writing. No cancellation or amendment fees will apply, as long as you advise us at least 35 days prior to departure. Any cancellations made within 35 days prior to departure will attract a 100% Cancellation Fee.

Minimum Numbers  - Usually a minimum of 4 confirmed travelers will be sufficient for the departure of a journey. We can operate some journeys with as few as 2 travelers, while some specialist trips cannot operate with less than 7 travelers or 10 travelers. Where minimum numbers are not reached at least 40 days prior to departure, or where the group size falls below minimum numbers between 40 and 35 days prior to departure, you will be given the following options:

• An alternative departure date or an alternative journey commencing on a date close to the date of the originally booked journey. No amendment fee will apply. Any price difference will be deducted from or added to your final invoice. 
• The option of undertaking the journey on an 'independent' basis. In that case you will travel privately, with different local guides at different cities. There may be additional costs to arrange the journey on an independent basis; if so, we will advise of these costs. This option is available for most, but not all journeys. 
• Cancellation of participation without penalty, as long as we are advised at least 35 days prior to journey departure.

Thrillophilia makes a final decision whether to operate a tour or not 3 days before its commencement. We cannot accept responsibility for costs incurred to change or cancel flight tickets not booked by Thrillophilia which are issued more than 3 days prior to departure, unless we previously guaranteed in writing that the journey will operate.

Fixed Itinerary : The client should stick to the Itinerary decided mutually between Thrillophilia and its clients. Any variation in the itinerary on the day of event will not be entertained. If client still forces a change in itinerary no adjustment or refund will be done in the advance payment done. Any extra service taken will be charged accordingly.

Single Travelers - 'Willing to Share'  - Single travelers may avoid paying a single supplement by electing to travel on a 'Willing to Share' room basis on our Group Journeys. If we are unable to match a Willing to Share traveler with another Willing to Share traveler of the same sex, we will confirm a single room at the twin share price. We advise travelers seeking a single room to book and pay the single supplement.

When sharing a hotel room with another Willing to Share non-smoker, you must not smoke in the hotel room. We will use our reasonable efforts to match non-smokers and people of approximately the same age, but this is not always possible.

The Willing to Share option is not available on Deluxe journeys, Family Journeys, the Vietnam Revealed (flight) journey, or for travelers under the age of 18. On all overnight train trips and home stays all clients will be in shared compartments, even if a single supplement has been paid. This is because of cabin/ room design for these services. The Willing to Share option is generally not available for booking requests received within 45 days of departure.

Merging Classic & Deluxe Group Journeys  - From time to time we may make a decision to merge  Group Journey that follows the same itinerary on the same departure date. This will be done at times when group size, hotel location and logistical issues allow this to be done with no negative impact on your vacation. We will merge tours when we feel we will be able to provide the best possible experience by doing so. At no times will a merged tour exceed the maximum passenger number for that destination.

Families & Children  - Our Group Journeys are open to people 12 years of age and over. As travelers under 18 cannot participate in the journey on a Willing to Share basis, such travelers will need to either share a room with a parent or another family member, or pay the single supplement. There are no reductions in price for 12 to 17 year olds. We have however developed a separate range of Family Group Journeys (minimum age 5).

Triple Share  - It is not possible to guarantee triple share rooms on our Group Journeys. This is because many hotels either do not have triple-bed rooms, or have fold-way beds only, which often make for a cramped room. Travelers can request a triple room at the time of booking, however the booking will be confirmed as double/twin plus a Willing to Share. During the journey a triple share room will be provided wherever possible, but usually a double/twin room plus a Willing to Share room will be provided. There are no reductions in price for triple sharers.

Health, Mobility & Fitness  - Each Group Journey in our brochure has a grading to assist you in choosing a vacation best suited to your level of fitness. A guide to grading is as follows:

Easy  
Suitable for travelers with an average level of fitness and independent mobility. Expect a fair amount of walking and you may need to carry your bags from time to time. You will also be boarding boats, climbing stairs on a regular basis and frequently negotiating rough and uneven surfaces. Accommodations are comfortable throughout and traveling conditions are easy.

Easy to Moderate  
Suitable for travelers with an average level of fitness and independent mobility. Expect a fair amount of walking and you may need to carry your bags from time to time. You may also be boarding boats, climbing stairs on a regular basis and frequently negotiating rough and uneven surfaces. Some long rail travel or road journeys may be involved. Accommodations are comfortable throughout.

Moderate  
Suitable for travelers with an average level of fitness and independent mobility. Expect lots of walking and you may need to carry your bags from time to time. You will also be boarding boats, climbing stairs on a regular basis and frequently negotiating rough and uneven surfaces. Some long road and rail journeys may be involved and some basic accommodation and basic facilities may also be a part of your experience.

Moderate to Adventurous  
Suitable for travelers with an average level of fitness and independent mobility; a keen sense of adventure is important. Includes a fair amount of walking and may include some basic accommodation in remote areas such as longhouses and/or minority accommodations with basic shared facilities. May involve some long road and/or rail journeys through remote regions. You may need to carry your bags from time to time. You may also be boarding boats, climbing stairs on a regular basis and frequently negotiating rough and uneven surfaces.

Adventurous  
Suitable for travelers with a good level of level of fitness, full and independent mobility; a keen sense of adventure is essential. Includes a lot of walking and basic accommodation in remote areas including longhouses and/or minority accommodations with basic shared facilities. You may need to carry your bags from time to time. You may also be boarding boats, climbing stairs on a regular basis and frequently negotiating rough and uneven surfaces. Also involves occasional days of intensive traveling - frequently in basic conditions. May also include adventurous activities such as trekking and cycling.

Minimum Fitness Levels/ Statement of Fitness  - It is essential for group dynamics that the presence of a less able traveler does not significantly affect enjoyment of the journey for others in the group. We ask you to carefully consider the above gradings and think carefully about the Group Journeys most appropriate for your level of health and fitness. While it is not a requirement to undertake rigorous fitness regimes to join our vacations, traveling with us does require a capacity and willingness to engage in physical activity. All our trips, whatever their grading, require walking and general mobility. Travelers must be able to walk reasonable distances unassisted, negotiate uneven surfaces, climb stairs and board boats as the journey requires. Some journeys involve long distance travel and occasional basic accommodation.We have established the following Minimum Fitness Criteria, relevant for all our Group Journeys. These criteria have been established both in your own interests and in the interests of your fellow travelers. By making a booking for a Thrillophilia  Journey you are explicitly acknowledging and agreeing to the following:

1) That all members of my party have the necessary levels of health and fitness to undertake a Thrillophilia Journey.
2) In particular, that each member of my party can do the following unassisted (Minimum Fitness Criteria):

• Walk 1-2 miles comfortably (in humid and hot conditions). 
• Walk up 4 flights of stairs comfortably. 
• Walk comfortably along rough and unstable surfaces. 
• Negotiate boarding small boats, trains etc. 
• Carry their own luggage (in the case of children, this can be with the assistance of an adult)

3) That a doctor will be consulted should I be unsure about the ability of any member of my party to perform the above activities.
4) That if a member of my party is unable to do any or all of the above, that person will be ineligible to participate in a Journey.
5) That I will declare any pre-existing medical conditions (physical or mental) and/or any other relevant information which may affect the ability of a member of my party to undertake the journey/s, overall group dynamics, and/or which Thrillophilia should reasonably expect to be made aware of, in advance of final booking confirmation. Thrillophilia has the right to ask for doctor's certificate where a member of your party is over 70 years of age or has a pre-existing medical condition.
6) That I will declare details of medication taken by members of my party on a regular basis, in advance of final booking confirmation. 
7) That, upon commencement of a journey or at any stage during a journey, the tour leader has the right to prevent members of my party from journey participation. This right is exercisable if the tour leader decides, in his/her sole discretion, that a member of my party is unable to perform any of the above mentioned Minimum Fitness Criteria activities, or if I have omitted to declare a pre-existing condition which affects my interests, the interests of my party, or the interests of the rest of the group. In such a circumstance, a refund will not be provided for unused services.

Final confirmation of a booking is subject to receipt of complete and accurate information about the fitness of all members of your party. If you are at all concerned about the physical ability of any member of your party to undertake a Group Journey, we recommend tailored travel arrangements. We would be happy to assist in organizing these.

Tour Leader Authority  - When on the journey you must abide by and comply with the authority and reasonable directions of the tour leader who represents Thrillophilia. At all times the decision of the Thrillophilia tour leader will be final on matters regarding group dynamics, and individual or group safety and well-being. If a tour leader takes the view that you are unable to meet the 'Minimum Fitness Criteria' above, in your interests and in the interests of the group, the tour leader may in his/her sole discretion prevent you from further participation in the journey. Additionally, should you fail to comply with a decision or direction of the tour leader, interfere with the well-being of the group, fail to respect the rights or beliefs of your fellow travelers or commit an illegal, obscene or otherwise inappropriate act while on journey, the tour leader may in his/her sole discretion prevent your further participation in the journey. In such instances, we will use our reasonable efforts to assist with onward travel arrangements for the relevant traveler. No refund will be given for any unused portion of the journey.

Consumer Claims  - We strive to ensure your arrangements are delivered smoothly, however there are times when problems arise on the ground. You should first try to resolve service problems with the provider of the service. If the problem cannot be resolved you should contact the emergency contacts provided in your detailed itinerary. If you fail to take these steps you may be affecting your recourse for a future claim. If a problem is not resolved during your journey you should send us written correspondence detailing the nature of your complaint as well as the efforts you went to resolve the problem while on tour. Please send this correspondence to us, with supporting documentation, via your travel consultant, within 30 days of the date of service delivery. We will not consider claims made after this period.

Group Journey Documentation  - A Group Journey dossier is available from your consultant or can be downloaded from our website. The dossier outlines tour details as well as initial pre-departure information. Upon receipt of full payment you will be provided with a detailed itinerary and a comprehensive pre-departure guide with useful, detailed information about your vacation destination. This information is generally provided to you 1 weeks prior to departure, and will not be provided until you have paid in full. Should there be a discrepancy between information contained on our website and journey documentation, journey documentation information will prevail. Close to date of departure, we recommend you download a journey dossier from our website, to be sure you carry an up-to-date version while traveling.

A Flexible Attitude  - All of the journeys have been carefully planned and researched. From time to time however, we may adjust journeys in order to improve them from an operational perspective. Local conditions may sometimes require adjustment to journeys during their operation. Whilst we endeavor to avoid such scenarios, they are an occasional, unavoidable feature of traveling in this region. If such journey adjustments become necessary, a flexible attitude will ensure that they do not detract from your overall experience and the experience of other group members. Please note that we reserve the right to levy extra charges over and beyond the trip price, when, due to exceptional circumstances we are forced to pay for additional, unforeseen tour arrangements. Thrillophilia prides itself on high levels of operational integrity. We are also proud of our travelers and the positive and informed approach they exhibit in dealing with different and sometimes challenging local conditions.

Governing Law  
This agreement and each TOS shall be governed by and constructed in accordance with the laws of India without reference to conflict of laws principles and disputes arising in relation hereto shall be subject to the exclusive jurisdiction of the courts of Bangalore, Karnataka.

Luggage  - Standard-sized bags (preferably soft bags), backpacks or soft cases only are permitted on our journeys. Your baggage should be clearly labeled and kept to a reasonable minimum. Luggage limits on airlines are strictly enforced and space on vehicles and trains is limited. Some flights booked through Thrillophilia (domestic and international) have a luggage limit of 44 pounds per person. You may be required to carry your own luggage at times where porters are not available - you should be capable of carrying your own bags on and off trains, and up and down stairs. If you are doing lots of shopping during your travels, it may be necessary for you to forward any excess to the city where your journey concludes, or ship purchases directly home. Keeping the amount of luggage you carry in check will ensure your safety and comfort, and the safety and comfort of your fellow travelers.

Our Privacy Policy  - You consent to our processing personal information about you and other members of your party. We will hold your name, address and any other details you supply us with on our database. This information will be used to make your travel arrangements and to send you information about Thrillophilia. In order to make your travel arrangements we will need to pass your details to companies and individuals outside North America, where less stringent data protection controls may be in place. We will not pass on your details to any third parties that are not responsible for your travel arrangements. Full details of our privacy policy can be found on our website.

Errors and Omissions  - We reserve the right to correct any errors in rates quoted or calculated for any service, with immediate effect. We will use our reasonable efforts to notify you of such corrections.

Important Notes  - If any part of these Terms and Conditions is determined to be invalid or unenforceable pursuant to applicable law then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely reflects the intent of the original provision and the agreement shall continue in effect. Thrillophilia reserves the right to change the terms, conditions, and notices contained herein and will use its reasonable efforts to notify you of any material change.
